no /dev/sndstat or /proc/sound, sound still works

2.3.50, changes to drivers/sound/Makefile to get it to compile as
modules and Viro's patch to fs/namei.c.

When sound modules are loaded*, sound works perfectly for me (no
problems opening /dev/dsp), but /proc/sound isn't created. In
addition, trying to access /dev/sndstat (cat, for example) gives me

cat: /dev/sndstat: Invalid argument

The error returned is EINVAL.

As an additional factoid, if I try to access /dev/sndstat with the
sound modules unloaded, kmod loads the modules correctly, but the call
still returns the same error.

* The following sound modules are loaded: sb, sb_lib, uart401, sound,
  soundcore.
