the reason that it always failed because of the first check didn't mean it
would have passed the second check - hence I will need to recheck/retest
and present a more coherent picture of what's going on - switching back
and forth between writing nullfs and investigating what may be (not 100%
proven yet) a VFS bug didn't generate a clear picture yet.
