fuser broken with newer 2.1.X ?

is fuser broken with the 2.1.61 kernel ?

I got no output from
fuser /tmp/isdn.log
so fuser -k /tmp/isdn.log won't work too.

isdn.log is busy and grows up (is created via cat /dev/isdnctrl
>/tmp/isdn.log &).
I am using the 2.1.61 kernel with Andi Kleens patch for the /dev/isdn*
stuff).

fuser is from the psmisc 0.16 and fresh recompiled, all new libs/programs
from Documentation/Changes are installed.

Any hints ?
