Of course you can. The USPO has shown itself to be utterly incapable of rational
function. And since it takes 5 years and a few million dollars to sort out
each individual screw up they make its worth patenting anything you can sneak
past the examination monkeys.

Until the US acquires a process whereby a patent violation claim can be contested
cheaply and cleanly by lodging prior art with the USPO so that most stupid items
don't get dragged through the courts for 15-20 years then it won't change either.

People abuse the US patent system because it is good economic sense to do so, and
like Spam mail it will continue until its made bad economic sense
