Actually, the file in question (head.S) *does* bear a copyright, but
doesn't mention any specific license restrictions. Personally, I find
it hard to believe they didn't know what they were doing, but at least
from talking to Linus they seem OK with fixing it. (Next time, maybe
they should ask first.)
BeLO is indeed derived from LILO; it says so right on the Be website.
Since LILO is under a BSD-like copyright, that's perfectly OK.
Incidentally, it also says that although Be won't support it, booting
BeOS with LILO works just fine.
That being said, personally I don't have a whole lot of problem if a
commercial developer want to use my code rather than writing something
from scratch. However, I have released my code under GPL; if they
want different terms then they have to speak to me first. (Remember,
the GPL doesn't prevent *the copyright holder* from also releasing the
code under different terms to specific clients.)
