but you're still doing
if (IS_MNT_SHARED(old_nd.path.mnt) && !capable(CAP_SYS_ADMIN))
goto out;
shouldn't it be something like
if (IS_MNT_SHARED(old_nd.path.mnt) && (old_nd.path.mnt & MNT_USER))
goto out;
?
