Perhaps this would read better as

	if (rc < 0) {
		if (rc != -EPIPE)
			dev_err(etc...);
		goto out;
	}

though for etc, perhaps
			dev_err(&chip->dev, "%s: %tpm_send: error %d\n",
				__func__, rc);
