kswapd buggy ?

maybe i don't understand what kswapd does :
i have no swap. everything is running fine. at least 99% of the time.
but when netscape needs too much memory, suddenly kswap is getting more
and more cpu time, the hard disk is getting busy all the time, and i can
push the reboot button, because it will not get better. login is not possible
(everything is much too slow), only ping works fine.

so i wonder why the kernel does not return SIGSEGV, SIGBUS or not allow to
allocate the memory. i wonder what kswapd does, since there is no swap to
manage...

for now i added made my swap partition a swap partition again (was used by
windows/games).

oh, kernel is 2.1.128, but i saw this in earlier 2.1 kernels, too.
